Even if the celebrity does not mind if you sell their portrait, you must still make sure that you are not violating any copyrights if you are basing your artwork on a reference photo.
An excellent example of this is the Associated Press vs. Shepard Fairy case. Obama was photographed by a photographer that was employed by the Associated Press during one of his many campaign speeches. Shepard Fairy gifted the image to Obama, who loved it so much, he used it as a campaign poster. But, the Associated Press did mind. They claimed the Associated Press owned the copyright to the photograph that Shepard Fairy used in creating the artwork.
Accusations were made. Other times not. I have a friend that paints icons of celebrities. Demtrie Kabbaz, out of St Louis. Most of the people he paints are long dead Marilyn, James Dean, etc. In the instance I am talking about.. I am keeping my mouth shut with him.. I was just curious if it was in fact illegal or what could happen if it were in a show, and lots of people saw it. Just projecting the pictures onto canvas, after a bit of Photoshopping?
When I was a teenager, I did a LOT of celebrity portraits and sometimes sold them to collectors or sold them to a friend of the actor or whatever. It was a great way to learn how to get a likeness and I found that because of the medium or colors used, I would put a lot of creativity in it.
It was far more time-consuming than just projecting the photo onto the canvas! Painting a celebrity as an original work of art, whether referencing a photo is definitely fair use in my opinion.
